Documents Required For Trademark Registration? A Complete List

In order to prevent any sort of unwanted use of the brand and protect the brand from infringement, trademark registration is quite important. The process of performing a trademark registration has been simplified by the Government of India. Now, the trademark registration can be easily obtained within a few months by the entrepreneurs for their brands. In this blog, we will learn about the documents that are needed to acquire a trademark registration in our country. Also, for a trademark registration, the applicant can submit the scanned copies of the original documents instead of the original documents.

 

Sole Proprietorship and Individuals

Any individual either a Foreign National or an Indian National, can apply for trademark registration in India. In order to get a trademark registration, the individuals do not have to form a legal entity or a business entity. Also, the documents required from an individual and from a proprietor are the same for trademark registration. These documents are listed below:

  1. ID Proof of the Proprietor or Individual.
  2. Address Proof of the Proprietor or Individual.
  3. Form- 48 which has been signed. It is an authorization from the side of the applicant to the Trademark Attorney in order to file an application for trademark on the applicant’s behalf.
  4. A copy of the logo(mainly preferred in black). If the logo is not availed, then the application for trademark can be filed for word.

 

The Trademark Registration Fee

The fee for trademark registration starts from Rs.4500 and ends at Rs. 9500. The fee that is applicable for trademark registration of startups, individuals, proprietorships and small enterprises is Rs. 4500. And for all other organisations, the trademark registration fee is Rs.9500. An Udyog Aadhar registration certificate will be needed in order to classify an organisation as a small enterprise. Along with the Udyog Aadhar, the below-mentioned details will also be required:

 

For LLP/ Company/ Partnership:

In case the applicant is either a partnership firm or an LLP, then the entrepreneur will need the following documents to do a trademark registration:

  • Copy of the logo which is optional
  • Form-48 which has been signed
  • A Registration Certificate of Udyog Aadhar
  • A partnership deed or a certificate of incorporation
  • ID proof of the signatory
  • Address proof of signatory

 

For all other Applicants:

For all those organisations which do not have a registration certificate of Udyog Aadhaar, but wish to do a trademark registration will need the following documents:

  • Copy of the logo(this is optional)
  • Form-48 which has been signed
  • A partnership deed or the certificate of incorporation
  • ID proof of Signatory
  • Address proof of the signatory
